美国总统拜登（Joe Biden）的“文件门”案持续延烧，继9日发现其就职副总统时期的机密文件后，11日再爆有第二批机密文件被发现。美国司法部长加兰（Merrick Garland） 周四（12日）宣布，任命前马里兰州联邦检察官赫尔（Robert Hur）为特别检察官，调查总统拜登私藏机密文件事件。面临相同性质风波的前总统川普，在第一批机密文件被发现时，就称拜登的行为属于刑事罪行，又指涉事的宾夕凡尼亚大学拜登中心曾经收到来自中国的捐款，声称中方接触到有关文件。
最先爆料拜登私人办公室里有机密文件的，是哥伦比亚广播公司《CBS》。总统特别法律顾问索柏（Richard Sauber）回应指，拜登的私人律师于去年11月2日、即中期选举前发现文件，他们当时在拜登就职总统前设于宾夕凡尼亚大学（University of Pennsylvania）拜登中心的华盛顿办公室，打包存放在上锁柜子内的文件，准备腾出办公空间。拜登于2009年至2017年的奥巴马政府时期任副总统，上述办公室则是他卸任副总统后，在2017年中旬开始使用，直至2020年竞逐总统为止。据悉，文件数量不到12份。
加兰披露了司法部接获通知称发现两批密件的时序。他称，在第一批密件被发现后，联邦调查局（FBI）于11月9日开始按照标准守则进行评估，以了解该些机密件是否在违反联邦法律的情况下被不当处理。11月 14日加兰指派联邦检察官劳施 （John Lausch Jr.） 进行初步调查，以让加兰决定是否任命特别检察官。
12月20日，拜登的私人律师通知劳施，在总统位于特拉华州威尔明顿的私人寓所的车库中，发现了其他密件。至今年1月5日，劳施向加兰简介初步调查结果，并建议任命特别检察官作进一步调查。
根据美国《总统档案法》（Presidential Records Act），若政府已不具执政资格，须将积机密文件移交国家档案局保管，拜登于2009～2017年期间担任前总统奥巴马（Barack Obama）的副手，卸任后并未依规定交还文件。
拜登对此事则表示“震惊”，称不知道文件内容，他周四（12日）还以“它们不是散落街头”来回应记者对第二批密件的有关提问。
东网报导称，前总统川普周一（9日）在旗下社交网发文回应事件，认为联邦调查局应该搜查白宫在内“拜登很多住所”；又指控宾夕凡尼亚大学拜登中心曾经收到来自中国、总数5,400万美元的捐款，“这是很多钱，他们（中国）看过机密文件”。他又重提自己卷入的机密文件风波，声言身为总统可以下令机密文件解密，但副总统就不可以，并受到属于刑事法律的联邦档案法规管。
川普2020年败选后，把白宫的文件搬到他的海湖俱乐部（Mar-a-Lago）住处，在迟未回应配合取回文件的要求后，有关当局去年8月搜查他的住处。
新任众议院议长、共和党人麦卡锡非常关注拜登事件，指这证明民主党对川普事件做得过火，调查行动有政治机动；当记者提到拜登一方已经“立即”交还涉事文件时，他揶揄“真的吗？他们在这些年后才找到它们？”麦卡锡提到拜登已经从政40年，但川普出任总统前没有担任官职，私藏机密文件时间亦没有对方那么长。
即将成为众议院监督委员会主席的共和党人科默（James Comer）直言，拜登与川普卷入的风波没有分别，执法部门不应该对两者的处理方式有异。
